PRIVACY POLICY

 

 The following provisions of the Bintern Privacy Policy (hereinafter referred to as the Policy) will govern the use of the User's personal information, the rights of users in accordance with the Personal Data Protection Act, the procedure in cases of unauthorized access to data and security measures. which Bintern undertakes for the confidentiality and protection of personal data.

 

§ Definitions

 

  1. Personal information. "Personal data"  is any information relating to an identified natural person or an identifiable natural person (personal data subject), and an identifiable natural person is a person whose identity can be established directly or indirectly, separately based on an identifier such as name and surname, citizen ID, location information, online identifier, or on the basis of one or more characteristics specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity that natural person;
  2. Processing of personal data. "Personal data processing"  means any operation or set of operations performed on personal data, or a group of personal data, automatically or otherwise, such as: collecting, recording, organizing, structuring, storing, adjusting or modifying; withdrawal, consultation, inspection, use, disclosure through transmission, publication or otherwise made available, reconciliation or combination, restriction, deletion or destruction;
  3. Controller. "Controller"  is Bintern which independently determines the goals and the manner of processing of personal data, and when the goals and the manner of processing of personal data are determined by law, the same law determines the controller or the special criteria for its determination;  
  4. Supervisory body. "Supervisory body" is a natural or legal person, public institution, agency or other body, which alone or together with others, decides on the purposes and methods of processing personal data; where the purposes and methods of such processing are in accordance with the positive laws of the Republic of Northern Macedonia and the Law on Personal Data Protection.
  5. Collection of personal data. "Personal data collection"  is a structured set of personal data that is available in accordance with specific criteria, whether centralized, decentralized or distributed on a functional or geographical basis;
  6. Personal data collection processor. "Personal Data Collection  Processor " means a natural or legal person, employed or hired by Bintern, who processes personal data on behalf of Bintern;
  7. Consent. "Consent"  of the personal data subject is any freely given, concrete, informed and unambiguous declared will of the personal data subject, through a statement or clearly confirmed action, which expresses consent for the processing of his personal data; 
  8. Violation of personal data security. "Violation of personal data security"  means any breach of security that results in the accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access of personal data transmitted, stored or otherwise processed.

 

§ Consent

 

 The user agrees that with the registration of the Bintern Platform, ie. by creating his user account, he agrees to give his free, concrete, informed and unequivocal stated will as consent to the processing of his personal data in accordance with the purposes set out below in this Privacy Policy.

 

 When registering with the User, Bintern only obtains the following data:

 

  • Name and surname;
  • Email address;
  • Phone Number;
  • Education

 

 Users state that they are aware that any particular field on the Platform that is used to enter information is optional, and certain information may not be entered where it is specified, which means that filling in the fields that are not exactly marked as " mandatory ”remains at the sole discretion of the User.

 

The User agrees that the Platform uses location-based services which means that the Platform will automatically receive the computer Internet Protocol - the IP address of the User's device. Such information according to the part of § Definitions  independently, but also in combination with others is personal data.

 

The automatic acquisition of the IP address can be used by the Platform for obtaining information about the browser and the operating system of the User in order to provide the service and improve the experience and it is mandatory.

The User agrees that upon registering with the Platform, Bintern will send him a Weekly Newsletter and SMS to notify the User of new announcements. The user has the option to deactivate notifications, but can not deactivate notifications that are important for the operation of the Platform.

 

 

. Purpose of using the information and personal data

 

The personal data and other information related to a specific User, explained above, will be used to successfully fulfill the services of the Platform, ie to connect employers with job seekers.

 

 Personal data will be used exclusively for the purposes described in this section.

 

Reporting breaches of personal data security

 

 In case of breach of personal data security, Bintern ie. The controller shall without delay and where possible inform the Agency for personal data protection, within a period not longer than 72 hours from the realization of the violation of personal data security, except in the cases when the violation of personal data security will not affect to risk the rights and freedoms of the User. In cases where the aforementioned deadline will be breached, Bintern will notify the Agency with an explanation of the delay.

 

 In cases where the breach of personal data security may result in an increased risk to the rights and freedoms of the personal data subject, the Comptroller (Bintern) will notify such breach without delay. Such notification will be formulated by Bintern in a legible and comprehensible manner and will explain the nature of the breach of personal data security and will consist of:

 

  • The name and contact details of the Personal Data Protection Officer or other contacts from which more information can be obtained;
  • Possible consequences of violating the security of personal data;
  • Measures taken or proposed to be taken by Bintern to address breaches of personal data security and, where possible, measures to mitigate the consequences of such breaches.

 

The user declares that he / she agrees that in accordance with Article 24 paragraph (3) of the LPDP, he / she may not be informed about the breach of personal data security as defined in the previous paragraph of this section.

 

 

 

§ Right of access

 

 Users have the right to obtain confirmation from Bintern as to whether their personal data is being processed, the purposes of the processing, the categories of personal data processed, the recipients or categories of recipients to whom the personal data are or will be disclosed, the specified period in which personal data will be stored or if this is not possible the criteria used to determine that period, the existence of the right to correct and supplement and delete personal data, the right to send a complaint to the competent supervisory body, the source of data if such data is not collected by the User and the existence of an automated decision-making system, including profiling.

 

 Users will also receive a copy of their personal data, free of charge, in electronic format.

 

. The right to be forgotten

 

  The User has the right to be forgotten and to ask Bintern to delete the personal data relating to the User without delay. Bintern is obliged to delete the personal data of the then User, now the personal data subject if one of the following conditions is met:

 

  • Personal data are no longer needed for the purpose for which they were collected or processed;
  • The subject of personal information withdrew the consent on which the processing is based; 
  • Personal data must be deleted for compliance with positive legal regulations or a decision of a competent body.

 

§ Data transfer

 

 The user has the right to obtain the personal data relating to him / her which he / she has submitted to Bintern, in a structured, computer-readable and commonly used format / manner. The User has the right to transfer that information to other Controllers without difficulty from Bintern.

 

§ Privacy through design

 

 Bintern implements technical and organizational measures to ensure that only personal data needed and necessary for a particular processing purpose will be subject to processing.

 

 Bintern processes and retains only those personal data that are absolutely necessary for the successful operation of the Bintern Platform.

 

 Bintern has implemented the principles of personal data protection such as data minimization and has integrated the necessary protections in the processing in order to meet the requirements of the applicable law and the Law on Personal Data Protection, in order to protect the rights of personal data subjects.

 

. Disclosure of personal data

 

 Bintern will not disclose the personal data of the personal data subject to third parties.

 

 With the exception of the previous paragraph, Bintern will disclose and share the personal data of the personal data subject where it is mandatory in accordance with the positive legal regulations of the authorities and competent bodies.

 

§ Data processing security

 

 Bintern provides security in the processing of personal data in accordance with the implementation of internal acts as well as continuous learning, training and awareness raising among personal data processors.

 In accordance with internal regulations, Bintern implements appropriate rules for:

-Authentication of authorized persons

-Providing the equipment on which personal data processing is performed

-Organization measures with segregation of duties and responsibilities

-Control of access to the information system

-Providing records for each access (logs)

-Internal network protection

-Providing the internet protocol and securing the platform, the website

-Backup (back up)

-other technical and organizational measures

 

 The data that will be shared with the User by Bintern, the User declares that he will keep it secret and in no way can process it for purposes other than the purposes of this Platform.

 The user has access to the job seekers at any time and to their data which are of public character.

. Cookies and the use of third party products 

 

 Bintern states that the Platform uses mandatory cookies for google analytics in order to improve the user experience.

These cookies provide statistics but the end user can not be identified.

 

§ Policy changes

 

 Bintern reserves the right to modify, revise or insert an entirely new Privacy Policy at its sole discretion at any time. Users will be notified of changes to this Policy on the Platform itself.
